New Accessible Parking Requirements Passed Into Law: What Do Illinois Community Associations Need To Know?

On August 9, 2024, new accessible parking requirements for Illinois condominium associations were signed into law by Governor Pritzker. The new law, which amends the Illinois Condominium Property Act, imposes certain new requirements related to parking for “a unit owner who is a person with a disability who requires accessible parking.” This change in the law takes effect on January 1, 2025. 

Per this new law, condominium boards must:

  • Adopt a policy to reasonably accommodate unit owners who require accessible parking by April 1, 2025 (i.e., 90 days from date the new law takes effect); and
  • Make reasonable efforts to facilitate a resolution between unit owners to provide for accessible parking” in situations where the association does not “own or otherwise control parking that meets the accessible parking needs of a unit owner who is a person with a disability who requires accessible parking.”
