As a guest on the American College of Trust and Estate Counsel’s (ACTEC) podcast “Trust and Estate Talk,” Lauren Wolven discussed the thorny ethical questions that can arise in estate planning. Helping families and older adults can often be tricky when legal matters involve personal and sensitive issues, and at times it can be difficult to determine whose interests the lawyer is supposed to represent.

Using recent cases of disciplinary actions and disqualifications, Lauren highlighted important ethical issues that estate planners need to keep in mind, including conflicts of interest, serving clients with diminished capacity, and communication lapses that can come back to haunt attorneys.
